1. About these terms
SparkSlides makes software tools for people who work with presentations. These terms govern your use of our tools, the websites we operate, and any digital product you purchase from sparkslides.com.
By using our tools or buying a product, you agree to these terms. If you do not agree, do not use the tools.
In these terms, "we", "us" and "SparkSlides" mean the SparkSlides business operated from Canada. "You" means the person or organisation using the tools.
2. Eligibility
You must be old enough to enter into a binding contract where you live, and you must have the authority to accept these terms on behalf of any organisation you represent.
3. Payments and merchant of record
Purchases made on sparkslides.com are sold and processed by our authorised reseller and merchant of record. The merchant of record is the seller of record for your transaction. It handles payment processing, issues your receipt, and collects and remits any tax that applies to your purchase.
This means:
- Your payment, your receipt, and any payment dispute or chargeback are handled by the merchant of record under its own terms.
- These terms govern your licence to use our tools and the outputs you create with them.
- We do not receive or store your payment card details at any point.
Purchases are one-time. We do not operate subscriptions and we do not store payment methods for future charges.
4. Our products
SparkEmbed is an add-in for Microsoft PowerPoint that displays live web pages inside a slide during a slideshow. It is delivered as a manifest file that you install into PowerPoint.
SparkPublish converts a PowerPoint file into an interactive web page hosted at a shareable link. It has a free tier and a paid tier, described in sections 9 and 10.
SparkText is a browser-based animated text generator with a free tier and a one-time Pro unlock.
SparkTemplates are downloadable PowerPoint template files.
Product features, limits and pricing may change. Changes apply to future purchases and do not remove a licence you have already bought.
5. Delivery
All products are digital and delivered electronically, immediately after purchase, as a download link, a licence code, or account credits.
You are responsible for giving a valid email address at checkout and for keeping any code or file delivered to you. Your receipt page lets you retrieve your code or re-download your file. If you lose both your email receipt and your code, contact support@sparkslides.com.
6. Licence and permitted use
When you buy a product, we grant you a non-exclusive, non-transferable licence to use that product for lawful personal or commercial purposes, including client work.
You own the content you create. Slides you embed, decks you publish, text you generate and templates you edit remain yours, and you may use the outputs in your own commercial work without further permission or payment.
You may not:
- resell, redistribute, sublicense, rent or share the tools, the licence codes, the credit codes, or the SparkEmbed manifest file
- publish or distribute our templates as templates, or as part of a competing template collection
- reverse engineer, decompile or tamper with the tools
- circumvent, or attempt to circumvent, any usage limit, watermark, expiry, rate limit or licensing check
- use automated means to create accounts, tokens or publishes at scale
Licence codes are issued to one buyer. A code shared publicly may be revoked.
7. Your content is your responsibility
SparkSlides is a tool. You are solely responsible for everything you embed, upload, publish or generate, including making sure that:
- you hold all rights, licences and permissions needed for that content
- it does not infringe anyone's intellectual property, privacy or other rights
- it does not break any law that applies to you or to your audience
- it does not contain confidential or personal information you are not entitled to share
We do not review, approve, endorse or claim ownership of your content, and we are not responsible or liable for it. We do process it in order to run the service, as described in our Privacy Policy.
8. Published decks are public to anyone with the link
A deck you publish with SparkPublish is served from a public web address. Anyone who has the link can open it. Links are not listed in our site navigation and we ask search engines not to index them, but a link is not a password and a published deck is not private.
Do not publish confidential, sensitive or personal information you would not be willing to hand to a stranger.
If you need a deck taken down, see section 11.
9. Free tier
The SparkPublish free tier is offered as a trial of the paid product. Free publishes:
- carry a SparkSlides watermark
- expire automatically 3 days after publishing, after which the link stops working and the files are deleted
- are limited to a small number of publishes per day per browser
We delete expired free decks permanently. We cannot recover them. Keep your original PowerPoint file.
Free-tier limits, including the expiry period and the daily cap, may change at any time.
10. Paid credits and permanent decks
A SparkPublish credit is a one-time purchase. Redeeming one credit against one published deck removes the watermark and makes that deck's link permanent.
- A credit is bound to a single deck at the moment you redeem it, and cannot be moved to another deck afterwards.
- Unredeemed credits do not expire.
- Credits have no cash value and cannot be transferred, resold or exchanged.
What permanent means. We keep a paid deck online, without an expiry date, for as long as we operate the SparkPublish service. We do not set a time limit on paid links and we do not require a renewal payment to keep a deck online.
If we ever discontinue SparkPublish, we will give you reasonable advance notice at the email address used for your purchase and a period during which you can retrieve your content. We may also remove a deck if we are legally required to, or if it breaks section 12, or at your own request under section 11.
Permanence attaches to hosting, not to the feature set. We may improve, change or replace how a published deck looks and behaves over time.
11. Deleting a permanent deck
You can ask us to delete a permanent deck at any time. Write to support@sparkslides.com from the email address used for the purchase, and include the deck link and your purchase code.
When we delete a deck:
- the link stops working and the files are removed from active storage, then purged from our backups
- the deletion is permanent and we cannot restore the deck
- the credit you spent on that deck is used up. Deletion is not a refund and does not return a credit
Free decks need no request. They delete themselves at expiry.
Where the law gives you a right to have personal information erased, that right is described in our Privacy Policy and is not limited by this section.
12. Acceptable use
You agree not to use our tools to create, embed, upload, publish or distribute anything that:
- is unlawful, or promotes or facilitates unlawful activity
- infringes anyone's copyright, trademark, privacy or other rights
- is malicious, including malware, phishing pages, or content designed to deceive a viewer about who is behind it
- harasses, threatens, defames or endangers anyone
- is sexual content involving minors, or any material that exploits or endangers a child
- impersonates SparkSlides or suggests we endorse it
We may suspend access, revoke a licence code, or remove published content that breaks this section. Where we remove paid content for a breach, no refund is due.
To report content published through SparkPublish, write to support@sparkslides.com with the link and the reason. We act on credible reports.
13. Third-party websites and services
SparkEmbed displays websites we do not control. Those sites are governed by their own terms and privacy policies, and their content, availability and behaviour are their responsibility, not ours.
Many websites set security headers that instruct browsers to refuse to display them inside another page. Those sites cannot be embedded by SparkEmbed or by any similar tool. This is a decision made by the site owner and is not a fault in our product. SparkEmbed also needs a working internet connection during your slideshow.
We publish guidance on which sites embed reliably. We cannot guarantee that any particular website will remain embeddable.
14. Availability and changes to the service
We aim for high availability, but the tools are provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, and we may change, suspend or withdraw features, including free-tier features, at any time.
We may perform maintenance that briefly interrupts publishing or viewing.
15. Purchases made through Etsy
Some of our products are also sold through Etsy. An Etsy purchase is a contract with Etsy as the seller platform and is governed by Etsy's policies, including its refund process. Section 6 of these terms still governs how you may use the product. Support is available at support@sparkslides.com either way.
16. Disclaimer of warranties
To the maximum extent permitted by law, we provide the tools and any content on our sites without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that a converted deck will reproduce your original file exactly, that any website will remain embeddable, or that any output will meet your requirements.
17. Limitation of liability
To the maximum extent permitted by law:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business, lost opportunity, or loss of data or content, however caused
- our total liability for any claim relating to a purchase is limited to the amount you paid for that purchase
- our total liability for any claim relating to free use of SparkPublish is limited to USD 2, the price of one publish credit
- our total liability for any claim relating to free use of SparkText is limited to USD 8, the price of a one-time Pro licence
- SparkEmbed and SparkTemplates are not offered on a free tier; a claim relating to either is covered by the purchase-liability limit above
Because a purchase becomes final once delivered (see our Refund Policy), the limit above is the ceiling on our monetary responsibility for a purchase-related claim; it does not create a right to a refund, and a refund is only available as described in that policy.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, and nothing limits any right you have under consumer protection law that cannot be waived by agreement.
18. Your indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss or expense arising from content you embed, upload, publish or generate, or from your breach of these terms.
19. Suspension and termination
We may suspend or terminate your access to the tools if you breach these terms. You may stop using the tools at any time. Sections 7, 8, 16, 17 and 18 survive termination.
20. Changes to these terms
We may update these terms. The current version is always posted on this page with its date. Material changes apply going forward, not retroactively to a purchase you have already made.
